Optus parades Sydney Mardi Gras 2012 on the world stage
with Mardi Gras TV

Optus today announced it will be the Official Digital Rights Partner of the Sydney Gay and Lesbian Mardi Gras (SGLMG) 2012, marking the first time the annual Sydney event will be shown to a worldwide audience via the internet.

Under the new digital partnership, Optus will show highlights from the Sydney Mardi Gras 2012 festival via SGLMG’s new dedicated website, Mardi Gras TV. The Optus powered website – www.mardigrastv.org.au – will go live on Monday 27 February 2012 and will feature content from the three week festival, including an exclusive interview with a high profile guest artist.

Produced and developed by Optus and directed by SGLMG, the website will include footage from Fair Day and Harbour Party 2012, a short history of Sydney Mardi Gras as well as high profile artist interviews and behind the scenes footage from the parade and after party. It will also feature a special one hour package of the Sydney Mardi Gras 2012 parade which will be available to view from 7.30pm (EST) on Sunday 4 March, exclusively on Mardi Gras TV.

Visitors to Mardi Gras TV will also be offered the chance to enter an exciting competition to win an ultimate Sydney Mardi Gras weekend experience, courtesy of Optus.

Michael Rolik, CEO, Sydney Gay and Lesbian Mardi Gras said the partnership with Optus provides an amazing opportunity to share Sydney Mardi Gras 2012 with a global audience.

"By showcasing Sydney Mardi Gras 2012 on the internet we are able to reach a larger audience than ever before. While Mardi Gras attracts more than 40,000 visitors to Sydney every year, this year for the first time viewers from around the world will be able to tune in and share the celebrations and excitement of our GLBTQI community Parade and festival.

OPTUS MARDI GRAS TV PROMOTION
CONDITIONS OF ENTRY

  1. Information on how to enter, mechanics of entry and prize packs form part of these Conditions of Entry. Entry into the promotion is deemed acceptance of these Conditions of Entry. Entry is via Internet or mobile Internet (carrier’s standard data charges apply) enabled mobile phones only. Some service providers and call plans may not provide access to mobile Internet. Entrants must check with their service provider if unsure.
  2. Entry is only open to residents of Australia aged 18 years or older who, in the event they are a winner, are able to attend selected Sydney Mardi Gras 2012 events on 3/3/2012 and 4/3/2012 (Mardi Gras Events) in order to participate in the prize (Entrants). The directors, management and employees (and their immediate families) of the Promoter, its related entities, printers, suppliers, providers and agencies whom are directly associated with the conduct of this promotion are ineligible to enter the promotion.
  3. The promotion starts at 3:00pm (AEDT) on 27/2/2012 and ends at 3:00pm (AEDT) on 1/3/2012 (Promotional Period).
  4. To enter the promotion, Entrants must, during the Promotional Period, log on to either www.mardigrastv.org.au or m.mardigrastv.org.au (via mobile Internet on the Entrant’s mobile phone) (each, a Promotional Website) and follow the prompts in the manner required to fully and correctly complete and successfully submit the online entry form, including providing the Entrant’s full name, State or Territory of residence, mobile phone number and current and valid email address, and answering in twenty-five (25) words or less the promotional question: “If you were a host on Mardi Gras TV who would be your co-host and why?”.
  5. Multiple entries are accepted however each entry must be submitted separately, must be substantially unique and must independently comply with these Conditions of Entry.
  6. Any entry that contains content that the Promoter, in its sole discretion, considers to be offensive, crude or inappropriate in any way or that the Promoter considers may infringe any intellectual property rights or other rights of any person, corporation or entity will not be accepted as an eligible entry into the promotion. This includes but is not limited to any entry which the Promoter considers to be disparaging of any of its products and/or services.
  7. Entries will be deemed accepted at the time of receipt by the Promoter and not at the time of transmission. Entries received will be considered final by the Promoter. Incomplete, inaccurate, erroneous, ineligible or incomprehensible entries will be deemed invalid. The Promoter accepts no responsibility for late, lost or misdirected entries. Contact details entered incorrectly by an Entrant on the Promotional Website will deem an entry invalid.
  8. Costs associated with accessing the Promotional Website remain an Entrant’s responsibility and may vary depending on the Internet service provider, usage plan or mobile carrier used.
  9. If an Entrant uses mobile Internet to participate in the promotion: Entrants must have the bill payer’s consent to use mobile Internet to participate in the promotion or their entry will be deemed invalid. Accessing mobile content including web-based content may incur data charges. Entrants will need to refer to the terms of their carrier contracts for details and costs as costs vary from plan to plan. The charges for all data services will appear on each Entrant's next mobile phone bill and/or Internet bill (as applicable). All general queries relating to carrier rates or mobile or Internet bills should be directed to the Entrants' mobile phone carrier or Internet Service Provider (as applicable).
  10. The use of any automated entry software or any mechanical, electronic or other means that allows an Entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that Entrant invalid.
  11. All valid entries will be judged by a panel of appropriately qualified judges by 2/3/2012 at the Promoter’s premises to determine the winners judged to be the best from all eligible entries received. All eligible entries will be judged on a basis of originality and creative merit. This is a game of skill and chance plays no part in determining the winners. Winners will be notified by telephone and in writing by 10:00am (AEDT) on 2/3/2012. Winners must notify the Promoter of their acceptance of their prize pack by telephone or email by midday (AEDT) on 2/3/2012. All reasonable steps to notify the winners of the results of the judging will be taken by the Promoter. Judges’ decision is final and no correspondence will be entered into.
  12. The three (3) entries judged to be the best from all eligible entries received will each win one (1) prize pack, valued at $700.00 each. Each prize pack comprises of the following double passes (for the winner and one (1) companion aged 18 years or older):
    1. one (1) double pass for Best in the House seats at Glamstand on 3/3/2012 to watch the Sydney Mardi Gras Parade, including entertainment hosted by Vanessa Wagner and featuring artists Tim Campbell, Kate Monroe, Sarah McLeod and Leo Sayer, valued at $360.00;
    2. one (1) double pass to the official MARDIGRASLAND Party at The Entertainment Quarter, Moore Park NSW 2021 on 3/3/2012, featuring artists RuPaul, Sneaky Sound System, Sam Sparro, Chicane and Kylie Minogue, valued at $260.00; and
    3. one (1) double pass to Laneway on 4/3/2012 at Hill Street, Surry Hills NSW 2010, featuring DJs Sveta, Adam Love, Mark Alsop, Alex Taylor, Kate Monroe, Oxford Hustlers and Wayne G, Francisco Guerra and Zoë Badwi, valued at $80.00.
  13. Prize packs do NOT include travel and/or transport to and from the winner’s ordinary residential address and Sydney, Australia, or accommodation in Sydney, Australia, or travel and/or transport to and from the Mardi Gras Events. For the avoidance of doubt, winners must make their own way (at their own cost and responsibility) to the Mardi Gras Events. Any other additional travel and accommodation expenses are also at the cost and responsibility of the winners (as applicable). Additional costs may include, but are not limited to, transfers, meals, beverages, room service, telephone calls, laundry services and spending money.
  14. The prize pack must be taken on 3/3/2012 and 4/3/2012 to coincide with the Mardi Gras Event dates. The Promoter accepts no responsibility for the cancellation, rescheduling, change or delay of a Mardi Gras Event or any part of a Mardi Gras Event for any reason beyond the control of the Promoter, including but not limited to the failure of a particular featured artist to perform at a Mardi Gras Event or the substitution of a particular featured artist with another performing artist at a Mardi Gras Event.
  15. Winners must collect their prize pack by 3:00pm (AEDT) on 2/3/2012 from the Sydney Mardi Gras Office at Suite 6/94 Oxford Street, Darlinghurst NSW 2010, unless an alternative collection arrangement has been agreed to by the Promoter in writing or by telephone. Prize packs not collected by this time (unless an alternative collection arrangement has been agreed to by the Promoter in writing or by telephone) will be forfeited.
  16. As a condition of entering this promotion, an Entrant consents to, in the event they are a winner, the Promoter using the Entrant’s name, likeness, image and/or voice (including photograph, film and/or recording of the same) in any media for an unlimited period of time without further notification, (including any outcome), and/or promoting any products or services manufactured, distributed and/or supplied by the Promoter. The Entrant agrees that, in the event they are a winner, the Entrant will participate in all reasonable promoted activities in relation to the promotion as requested by the Promoter and its agents.
  17. Entrants acknowledge that, in the event they are a winner, the attendance of the Entrant and their companion at a Mardi Gras Event may be recorded and reproduced on digital media, film, tape, photograph and by other means (the Footage). Each Entrant consents to the use of such Footage by the Promoter in any way in any media worldwide for the purposes of marketing and promoting the Promoter without the further consent of the winner and without any payment or compensation payable to the winner. The Promoter takes no responsibility for any editing of the Footage by third parties.
  18. The winners (and their companions) must conduct themselves in a professional, courteous and friendly manner at all times whilst attending a Mardi Gras Event. Acceptance of the prize pack and participation in the Mardi Gras Events is subject to any prevailing terms and conditions of the Mardi Gras Event organisers, and in particular, age, health, behaviour, and safety requirements. Any passes, tickets or vouchers issued by the Promoter as part of a prize pack are subject to prevailing terms and conditions of use and are not replaceable if lost, stolen or damaged. The winners (and their companions) must follow all reasonable directions given by the Promoter and any prize pack supplier during the course of their participation in the prize pack, including all directions relation to age, health, behaviour, safety or responsible consumption of alcohol. The Promoter reserves the right, in its sole discretion, to disqualify, sanction and/or remove a winner (and/or their companion) from a Mardi Gras Event on the grounds of inappropriate behaviour, for age, health or safety reasons, or for any breach of these Conditions of Entry generally. If a winner (or their companion) fails to participate in a Mardi Gras Event in the manner required, as stated in this condition and in the reasonable opinion of the Promoter, their entry and the balance of the prize pack will be forfeited with no compensation payable.
  19. Total maximum prize pool value is up to $2,100.00. Prize packs are not transferable or exchangeable and cannot be taken as cash (unless otherwise indicated). Prize packs must be taken as offered and cannot be varied. The Promoter accepts no responsibility for any tax implications that may arise from the prize pack winnings. Independent financial advice should be sought. The Promoter accepts no responsibility for any variation in prize pack value. All prize pack values are the recommended retail price including GST.
  20. The Promoter may award a prize pack to the next best judged entry by 12.30pm (AEDT) on 2/3/2012 in order to award the prize pack if unclaimed by that date. Any unclaimed prize pack winner(s) will be notified by telephone and in writing by 1:00pm (AEDT) on 2/3/2012. Winner(s) must notify the Promoter of their acceptance of their prize pack by telephone or email by 2:00pm (AEDT) on 2/3/2012. All reasonable steps to notify any unclaimed prize pack winner(s) of the results of the judging will be taken by the Promoter. Judges' decision is final and no correspondence will be entered into.
  21. Entrants can only enter in their own name. Entrants who provide incorrect, misleading or fraudulent information are ineligible to participate in the promotion and all entries of an Entrant who is deemed by the Promoter to have provided incorrect, misleading or fraudulent information may, at the discretion of the Promoter, be deemed invalid. The Promoter reserves the right to request the Entrant produce (within the requested time) appropriate photo identification or other documentation (to the Promoter’s satisfaction, at its sole discretion) in order to confirm the Entrant’s identity, age, residential address, eligibility to enter and claim a prize pack, and any information submitted by the Entrant in entering the promotion, before issuing a prize pack. If the documentation required by the Promoter is not received by the Promoter (or its nominated agent) or an Entrant or entry has not been verified or validated to the Promoter’s satisfaction then all the entries of that Entrant will be ineligible and deemed invalid.
  22. The Promoter reserves the right to request a winner’s companion produce (within the requested time) appropriate photo identification or other documentation (to the Promoter’s satisfaction, at its sole discretion) in order to confirm the companion’s identity and age before issuing the prize pack.
  23. The Promoter reserves the right to verify the validity of any and all entries and reserves the right to disqualify any Entrant for: (a) tampering with the entry process; (b) submitting an entry which is not in accordance with these Conditions of Entry; or (c) if the Entrant is engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved. A prize pack will only be awarded following any winner validation and verification that the Promoter requires in its sole discretion.
  24. It is a condition of accepting a prize pack that a winner (and their companion) may be required to sign a legal release or releases in a form determined by the Promoter and/or any prize pack supplier in its or their absolute discretion.
  25. Any attempt, deliberate or otherwise, to cause malicious damage or interference with the normal functioning of the Promotional Website or the information on the Promotional Website, or to otherwise undermine the legitimate operation of this promotion may be a violation of criminal and civil laws and, should such an attempt be made, whether successful or not, the Promoter reserves the right to seek damages to the fullest extent permitted by law. If the Promoter suffers loss or incurs any costs in connection with any breach of these Conditions of Entry or any other legal obligation by an Entrant, the Entrant agrees to indemnify the Promoter for those losses, damages and costs.
  26. If a prize pack or element of a prize pack becomes unavailable, for any reason beyond the Promoter’s reasonable control, then a comparable prize pack or prize pack element of equal or greater value will be awarded in lieu.
  27. If this promotion is not capable of running as planned for any reason beyond the reasonable control of the Promoter, including but not limited to war, terrorism, state of emergency or disaster (including natural disaster), infection by computer virus, bugs, tampering, unauthorised intervention, technical failures or anything which corrupts or affects the administration, security, fairness, integrity or proper conduct of this promotion, the Promoter reserves the right, in its sole discretion, to cancel, terminate, modify or suspend the promotion and/or, if necessary, to provide an alternative prize pack or prize packs to the same value as an original prize pack or prize packs.
  28. The Promoter, its associated agencies and companies excludes all liability (including negligence) except for any liability that cannot be excluded by law, for any direct or indirect injury, loss and/or damage arising in any way out of the promotion. This includes, but is not limited to: (i) technical malfunctions, delays or failures, including those resulting from accessing any materials related to this promotion and any incorrect, inaccurate or incomplete information communicated in the course of, or in connection with, this promotion as a result of any technical malfunctions, delays or failures; (ii) theft, unauthorised access or third party interference; (iii) lost or damaged entries, prize pack claims or prize packs; and/or (iv) acceptance and/or use of any prize pack. Applicable manufacturers and/or distributors should be contacted in regards to all prize pack warranty claims (if applicable).
  29. An entry and any copyright subsisting in an entry irrevocably becomes, at time of entry, the property of the Promoter. The Promoter collects personal information about an Entrant to include the Entrant in the promotion and, where appropriate, award a prize pack. If the personal information requested is not provided, the Entrant cannot participate in the promotion and is deemed ineligible. An Entrant also agrees that the Promoter may, in the event the Entrant is a winner, publish or cause to be published the winner’s name and locality in any media. An Entrant can gain access to, update or correct any personal information held by the Promoter by contacting the Promoter’s Privacy Officer at: PO Box 306, Salisbury South SA, by telephone on 133 345 or online via www.optus.com.au. All personal information will be stored at the office of the Promoter. Optus Privacy Policy

This Privacy Policy sets out the approach which Optus will take in relation to the treatment of Personal Information. It includes information on how Optus collects, uses, discloses and keeps secure, individuals' Personal Information. It also covers how Optus makes the Personal Information it holds available for access to and correction by the individual.

This policy has been drafted having regard to Optus' obligations under the Telecommunications Act 1997 and the Privacy Act 1988 (including the National Privacy Principles) (the Privacy Act). Nothing in this Policy changes Optus' existing obligations under the credit reporting requirements of the Privacy Act.

This Policy is a public document and has been prepared in light of National Privacy Principle 5, Openness.

1. Collection

1.1 Optus will only collect Personal Information where the information is necessary for Optus to perform one or more of its functions or activities. In this context, "collect" means gather, acquire or obtain by any means, information in circumstances where the individual is identifiable or identified.

1.2 Optus collects Personal Information primarily to supply customers with the products and services ordered from it and its related companies. Optus also collects and uses Personal Information for secondary purposes including:

(i) billing and account management;
(ii) business planning and product development; and
(iii) to provide individuals with information about promotions, as well as the products and services of other Optus companies and other organisations.

1.3 Optus will notify individuals (including, but not limited to, our customers) of the matters listed below before collecting any Personal Information:

i) the main reason that we are collecting Personal Information (this reason will be the Primary Purpose);
ii) other related Uses or Disclosures that we may make of the Personal Information (Secondary Purposes);
iii) our identity and how individuals can contact us, if this is not obvious;
iv) that individuals can access the Personal Information that Optus holds about them;
v) that individuals should contact our customer service department (even if they are not a customer) if wish to access or correct Personal Information collected by us or have any concerns in relation to Personal Information;
vi) the organisations or types of organisations to whom we usually Disclose the Personal Information including Related Bodies Corporates and contractors;
vii) where applicable, any law that requires the Personal Information to be collected (for example, information that is required to be collected for the Integrated Public Number Database which is used by directory publishers);
viii) the consequences (if any) for the individual if all or part of the Personal Information is not provided to Optus.

1.4 Where it is not practicable for Optus to notify individuals of all of the Collection Information before the collection of Personal Information, Optus will ensure that individuals are notified of the Collection Information as soon as possible after the collection. Optus will provide "post collection notification" in those circumstances where it is not practicable to notify individuals about the collection of their personal information before it is collected.
1.5 When collecting Personal Information over the telephone, it may not always be practicable to provide all the Collection Information at that time. In such circumstances, we will provide the individual with Optus' contact details, and then provide the balance of the Collection Information in a confirming letter.
1.6 Optus will not collect Sensitive Information from individuals except with consent and only where it is necessary for Optus to collect such information for an activity or function.
1.7 Optus will not collect Personal Information secretly or in an underhanded way.
1.8 Optus will take steps to ensure that individuals on purchased lists are or have been notified of the information as outlined at 1.3.

2. Use

2.1 Optus will obtain an individual's consent for Use of non-sensitive Personal Information for Secondary Purposes at the time of collection, unless the Use is a related Secondary Purpose which would be within the relevant individual's Reasonable Expectations.
2.2 Optus Uses Personal Information primarily for the purposes listed in 1.2 above.
2.3 If Optus relies on the Direct Marketing exception to Direct Market to individuals it will ensure that:
i) individuals are clearly notified of their right to Opt Out from further Direct Marketing;
ii) there is only one Use of the information before the Opt Out right is given and this Use applies across all Optus' Related Bodies Corporate (if the information is shared between those Related Bodies Corporate);
iii) the individual is given an Opt Out in all further instances of Direct Marketing if they have not previously chosen to Opt Out; and
iv) if the individual Opts Out of all Direct Marketing the Opt Out will be respected by Optus and all its Related Bodies Corporate.
2.4 Optus will not use Sensitive Information for Direct Marketing.
2.5 Optus may use Personal Information to avoid an imminent threat to a person's life or to public safety. It may also use Personal Information for reasons related to law enforcement or internal investigations into unlawful activities.
2.6 Optus will not use Personal Information without taking reasonable steps to ensure that the information is accurate, complete and up to date.
2.7 Optus will not attempt to match de-identified or anonymous data collected through surveys or such online devices as "cookies", with information identifying an individual, without the consent of the relevant individual.

3. Disclosure

3.1 Optus may Disclose Personal Information to related or unrelated third parties if consent has been obtained from the individual. This will include obtaining the individual's consent for Disclosures made under the credit reporting requirements of the Privacy Act.
3.2 Optus may Disclose Personal Information between Related Bodies Corporate. Where information is Disclosed to such a Related Body Corporate, that Related Body Corporate is bound by the original Primary Purpose for which the information was collected.
3.3 Optus may Disclose Personal Information to unrelated third parties to enable outsourcing of functions (such as billing), where that is Disclosure or Use for a related Secondary Purpose and has been notified to individuals or where such Disclosure is within the individual's Reasonable Expectations. Individuals will be notified of Optus' usual Disclosures via the Collection Information, as outlined in 1.3.
3.4 Optus will take reasonable steps to ensure that its contracts with third parties include requirements for third parties to comply with the Use and Disclosure requirements of the Privacy Act.
3.5 Optus may Disclose Personal Information to law enforcement agencies, government agencies, courts or external advisers where permitted or required by law.
3.6 Optus may Disclose Personal Information to avoid an imminent threat to a person's life or to public safety.
3.7 If a Disclosure is not for a Primary Purpose; is not for a related Secondary Purpose; or upfront consent has not been obtained, Optus will not Disclose Personal Information otherwise than in accordance with the exceptions set out at 3.1 to 3.6 above.
3.8 Optus does not generally sell or share its customer lists on a commercial basis with third parties but if it did, it would only do so if we had the appropriate consent of the individual involved. If the consent provided is conditional, Optus will take steps to ensure (by contract) that the use of its customer list by third parties does not exceed the scope of the consent.

4. Information quality

4.1 Optus will review, on a regular and ongoing basis, its collection and storage practices to ascertain how improvements to accuracy can be achieved.
4.2 Optus will take steps to destroy or de-identify Personal Information after as short a time as possible and after a maximum of seven years, unless the law requires otherwise.

5. Information security

5.1 Optus requires employees and contractors to perform their duties in a manner that is consistent with Optus' legal responsibilities in relation to privacy.
5.2 Optus will take all reasonable steps to ensure that paper and electronic records containing Personal Information are stored in facilities that are only accessible by people within Optus who have a genuine "need to know" as well as "right to know".
5.3 Optus will review, on a regular and ongoing basis, its information security practices to ascertain how ongoing responsibilities can be achieved and maintained.

6. Access and correction

6.1 Optus will allow its records containing Personal Information to be accessed by the individual concerned in accordance with the Privacy Act.
6.2 Optus will correct its records containing Personal Information as soon as practically possible, at the request of the individual concerned in accordance with the Privacy Act.
6.3 Individuals wishing to lodge a request to access and/or correct their Personal Information should do so by contacting Optus Customer Service, as per the details on the back of this document. While some requests for access may be handled by Customer Service, it may be necessary for your request to be escalated to the Optus Customer Relations Group.
6.4 Optus will not normally charge a fee for processing an access request unless the request is complex or is resource intensive. Optus does, however, reserve the right to charge a $25.00 administration fee if an individual requests access to their Personal Information more than once in a three month period.
6.5 Where Optus offers on-line account management facilities, customers can use this capability to control aspects of their account, including amending or updating certain Personal Information.


7. Openness

7.1 Optus' Customer Service representatives will be the first point of contact for inquiries about privacy issues. Individuals wishing to make an inquiry or complaint regarding privacy, should do so by contacting Optus Customer Service, as per the details on the back of this document.
7.2 Privacy complaints will be managed in accordance with Optus' Complaint Handling Policy, which complies with the C628:2007 Telecommunications Consumer Protections Industry Code (as amended from time to time).
7.3 Optus websites will contain a prominently displayed privacy statement and will include a copy of this Optus Privacy Policy.


8. Anonymous transactions

8.1 Optus will not make it mandatory for visitors to its web sites to provide Personal Information unless such Personal Information is required to answer an inquiry or provide a service. Optus may however request visitors to provide Personal Information voluntarily to Optus (for example, as part of a competition or questionnaire).
8.2 Optus will allow its customers to transact with it anonymously wherever that is reasonable and practicable.

9. Transferring personal information overseas

9.1 Optus will take reasonable steps to limit the amount of Personal Information it sends to unrelated organisations overseas.
9.2 If Personal Information must be sent by Optus overseas for sound business reasons, Optus will require the overseas organisation receiving the information to provide a binding undertaking that it will handle that information in accordance with the National Privacy Principles, preferably as part of the services contract.

10. Glossary

Collection Information means the information outlined in 1.3 notified to individuals prior to, or as soon as practical after, the collection of their Personal Information.

Direct Marketing means the marketing of goods or services through means of communication including written, verbal or electronic means. The goods or services which are marketed may be those of Optus or a Related Body Corporate or those of an independent third party organisation.

Disclosure generally means the release of information outside Optus, including under a contract to carry out an "outsourced function".

Health Information means:
(a) information or an opinion about:
(i) the health or a disability (at any time) of an individual; or
(ii) an individual's expressed wishes about the future provision of health services to him or her; or
(iii) a health service provided or to be provided to an individual;that is also personal information; or
(b) other personal information collected to provide or in providing a health service; or
(c) other personal information about an individual collected in connection with the donation; or intended donation by the individual of his or her body parts or body substances.Opt Out means an individual's expressed request not to receive further Direct Marketing.

Optus means all companies in the Optus group, including Optus Networks Pty Limited, Optus Mobile Pty Limited and Optus Administration Pty Limited.

Personal Information means information or an opinion (including information or an opinion forming part of a database), whether true or not and whether recorded in a material form or not, about an individual whose identity is apparent, or can reasonably be ascertained from the information or opinion.

Primary Purpose is the dominant or fundamental reason for information being collected in a particular transaction.

Reasonable Expectation means a reasonable individual's expectation that their personal information might be Used or Disclosed for the particular purpose.

Related Body Corporate means that where a body corporate is:

  • a holding company of another body corporate;
  • a subsidiary of another body corporate; or
  • a subsidiary of a holding company of another body corporate,

the first mentioned body corporate and the other body corporate are deemed to be related to each other.

Sensitive Information means:

(a) information or an opinion about an individual's:
(i) racial or ethnic origin; or
(ii) political opinions; or
(iii) membership of a political association; or
(iv) religious beliefs or affiliations; or
(v) philosophical beliefs; or
(vi) membership of a professional or trade association; or
(vii) membership of a trade union; or
(viii) sexual preferences or practices; or
(ix) criminal record;that is also personal information or
(b) Health Information about an individual.

Use means the handling of Personal Information within Optus.
